Terms of Service

The website linkfluencer.io, the Linkfluencer platform and the brand dashboard (together the "Services") are operated by Linkfluencer, a French société par actions simplifiée with variable capital, registered with the RCS of Créteil under number 929 237 451, registered office at 21 Rue du 18 Juin 1940, 94700 Maisons-Alfort, France ("Linkfluencer", "we", "us"). These terms of service (the "Terms") apply to everyone who accesses the Services. They fit into a documented hierarchy: creators using the Linkfluencer app are governed by the Creator Terms and Conditions, which prevail for them; brands are governed by their signed agreement with Linkfluencer, which prevails over these Terms in case of conflict; and the Privacy Policy and Cookie Policy describe how personal data and cookies are handled. By using the Services you accept these Terms.
Linkfluencer is a sales-first influencer marketing platform. Brands run campaigns through the platform; everyday shoppers and creators buy from those brands, post authentic content about their purchases on their own social media accounts, and earn cashback based on their Social Score, on the terms set out in the Creator Terms and Conditions. Brands are charged on outcomes under their signed agreement. Linkfluencer is not the seller of any brand's products and is not a party to the purchase between a shopper and a brand.
You may use the website for its intended purposes: learning about Linkfluencer, requesting a demo or contacting us, applying as a creator, and accessing the dashboard if you are an authorised brand user.
Information you submit through our forms (demo booking, contact) must be accurate How we use it is described in the Privacy Policy.
You must not: scrape, crawl or harvest data from the Services; reverse engineer, decompile or copy any part of the platform; probe or disrupt our infrastructure; use robots or automated access without our written consent; upload malicious code; or use the Services for any unlawful purpose.
All content on the website (text, design, logos, software, the Social Score methodology, campaign data and statistics) belongs to Linkfluencer or its licensors. We grant you a limited, revocable, non-exclusive licence to access and view it for your own use. No other rights are granted.
If you send us ideas or feedback, we may use them freely without obligation or compensation.
Access
Dashboard accounts are opened for brands that have entered into a signed agreement with Linkfluencer. The brand is responsible for its authorised users, for keeping credentials confidential and for all activity under its accounts. Access may be suspended in case of breach or security risk.
Fees
Linkfluencer's remuneration is defined in each brand's signed agreement or order form. Depending on the agreed model it may include, alone or in combination: a commission on verified sales (pay-on-outcome), funding of the campaign cashback budget, and subscription or setup fees. In case of conflict between these Terms and a signed agreement, the signed agreement prevails.
No performance guarantee
Performance figures published by Linkfluencer (such as return on investment or return on ad spend achieved by other clients) are historical examples. They are not a promise of results. Linkfluencer's obligations are obligations of means: we do not guarantee any level of sales, creator participation, content volume or commercial performance.
Brand obligations
Campaign information provided by the brand must be accurate, and its products and promotions must be lawful in every country where the campaign runs.
No campaigns are accepted for product categories whose promotion by influencers is prohibited or restricted by applicable law, including the French law no. 2023-451 of 9 June 2023.
Creator data visible in the dashboard (public handles, campaign content, aggregated statistics) may be used only to run and measure campaigns on the platform. Brands must not use it to contact, recruit or profile creators outside the platform.
Use of creator content by brands is governed by the licence chain described in the Creator Terms and Conditions: broad advertising use during the twelve-month assignment period, and continued display of already-published materials afterwards. Brands must respect those limits.

Unless the brand opts out by writing to team@linkfluencer.io, Linkfluencer may identify the brand by name and logo as a client reference on its website and in its commercial materials. The opt-out takes effect within 30 days for new materials.
Payment accounts and payouts for creators are provided by ConnectPay UAB, a licensed electronic money institution, under its own terms. Social networks (Instagram, TikTok) are independent services governed by their own terms. Links to third-party sites are provided for convenience; we are not responsible for their content.
We work to keep the Services available but do not guarantee uninterrupted operation. We may perform maintenance, and we may evolve, add or withdraw features as the platform develops. Material changes to these Terms will be published on the website with at least 15 days' notice before taking effect, except changes required by law or urgent security measures. Continued use after the effective date constitutes acceptance.
Personal data is processed as described in our Privacy Policy, and cookies as described in our Cookie Policy, both available on linkfluencer.io.
If any provision of these Terms is held invalid, the remainder stays in force. Our failure to enforce a right is not a waiver. You may not assign your rights under these Terms; Linkfluencer may assign them within its group or in connection with a corporate transaction. These Terms, together with the documents they reference (Creator Terms, signed brand agreements, Privacy Policy, Cookie Policy), form the entire agreement regarding use of the Services.
These Terms are governed by French law. If you are a consumer, you also benefit from the mandatory protections and jurisdiction rules of the country where you live, and you may use the amicable and mediation channels described in the Creator Terms. For brands and other professional users, any dispute relating to the Services is subject to the exclusive jurisdiction of the courts of Créteil, France, including for interim proceedings and notwithstanding multiple defendants or third-party claims.
