About Linkfluencer and these Terms

These terms and conditions (the "Terms") govern your use of the Linkfluencer mobile application and related services (the "App") as a creator. The App is operated by Linkfluencer, a French société par actions simplifiée with variable capital, registered with the Trade and Companies Register (RCS) of Créteil under number 929 237 451, whose registered office is at 21 Rue du 18 Juin 1940, 94700 Maisons-Alfort, France ("Linkfluencer", "we", "us"). Contact: team@linkfluencer.io.

By creating an account, ticking the acceptance box or using the App, you enter into a binding agreement with Linkfluencer on these Terms. If you do not agree, do not use the App. Payment accounts and payouts are provided by ConnectPay UAB, a licensed electronic money institution, under its own terms which you accept separately when completing identity verification.

Eligibility and your account

Eligibility and your account

Eligibility and your account

  • You must be at least 18 years old and legally capable of entering into contracts.

  • You must reside in the European Union, the European Economic Area or the United Kingdom.

  • You must hold at least one active, public Instagram or TikTok account that you personally own and control, with at least 1,000 followers.

  • Access is by application: you apply, connect your Instagram or TikTok account, your Social Score is calculated and, once verification is complete, your wallet is activated and you can take part in any Campaign.

  • Brand safety: Linkfluencer may decline an application, or offboard an account, whose content profile is incompatible with the platform's brand-safety standards, in particular accounts principally publishing adult or sexually explicit content, gambling, weapons, illicit substances, undisclosed crypto-asset promotion, hateful or extremist content, or political or religious agitation. Any such decision is notified with reasons and can be contested as described in clause 9.

  • You may hold only one Linkfluencer account. Information you provide must be accurate and kept up to date.

  • To receive payouts you must complete identity verification (KYC) with ConnectPay within the timeframe indicated in the App.

You use the App as an independent individual. Nothing in these Terms creates an employment relationship, agency, partnership or mandate between you and Linkfluencer or any Brand. You are responsible for your own tax and social security obligations on Rewards; where the law requires it (including Council Directive (EU) 2021/514, "DAC7", and equivalent UK rules), Linkfluencer or its partners will report information about you and your Rewards to the competent tax authorities.

Connected Accounts

Connected Accounts

Connected Accounts

To use the App as a creator you must connect at least one Instagram or TikTok account through the official interfaces provided by those platforms. By connecting an account you:

  • confirm that the account is yours, is public, and that you are entitled to connect it;

  • authorise Linkfluencer to retrieve and process data about the account and its performance (such as followers, engagement, audience characteristics and the performance of your posts) to operate the App, calculate your Social Score and verify Campaign participation, as described in our Privacy Policy;

  • agree to keep the account public and connected during any Campaign you take part in and for at least three (3) months after submitting a claim for it;

  • remain bound by the terms of the relevant platform (Instagram, TikTok), which are not under our control. We are not responsible for actions those platforms take on your account.

You may disconnect an account at any time in the App settings. Disconnecting an account may reduce or suspend your Social Score and your ability to take part in Campaigns.

The Social Score

The Social Score

The Social Score

The Social Score is an automated score out of 1,000 points that reflects the reach, quality and authenticity of your Connected Accounts. It is calculated from the following criteria: followers, engagement, like-to-view ratio, comment-to-like ratio, virality, and activity factors (including posting consistency and streaks, stardom status levels, and the performance of your Content, which can raise or lower the score). The score is dynamic: it moves up and down with these criteria, decreases in case of inactivity, declining engagement or poor content performance, and may be reduced as a penalty in the cases described in clause 9. Your current score and tier are visible in the App at all times. If a social network restricts or interrupts our access to account data, your score may be frozen or calculated on the data available until access is restored. Your Social Score determines the Reward tier that applies to you:

Changes to the Social Score system

The Social Score is a proprietary system that must evolve with the platform, the social networks it draws data from, and fraud patterns. Linkfluencer may therefore modify the methodology, metrics, weightings, tiers and rates at any time and at its discretion. Changes take effect when published in the App, and we will notify you promptly through the App. Two protections always apply: (a) a change never reduces Rewards that have already been confirmed to you; and (b) the rate displayed to you when you make a Campaign purchase is honoured for that purchase provided you submit your claim within fourteen (14) days of the purchase; for later claims, the rate displayed at submission applies, and a change occurring after submission never alters the rate for that claim.

Your guarantees around the score

  • The Social Score involves automated processing that significantly affects your Rewards. You may at any time ask for an explanation of your score, contest it and request a human review by writing to team@linkfluencer.io.

  • We do not guarantee any score level, tier or earnings. The score measures accounts, not persons.

  • Attempting to manipulate the score (purchased followers, engagement pods, bots, coordinated inauthentic behaviour) is a serious breach of these Terms (see clause 9).

Campaigns, Rewards and payouts

Campaigns, Rewards and payouts

Campaigns, Rewards and payouts

  • Participation in any Campaign is optional. Each Campaign displays its own conditions (eligible products, period, content requirements, Reward mechanics and any maximum cashback amount). Those conditions form part of these Terms for that Campaign. Linkfluencer does not run Campaigns for product categories whose promotion by influencers is prohibited or restricted by applicable law.

  • How you earn: for each Campaign, you must (1) shop with the Brand; (2) create and publish Content about your purchase on a Connected Account, complying with the Campaign conditions and clause 8; (3) submit your claim in the App with genuine proof of purchase (receipt); and (4) once verification is complete, receive cashback at your tier rate. All four steps are required: no cashback is due without a compliant published post and a verified purchase.

  • Verification: Linkfluencer verifies the proof of purchase and that a post exists for the right Brand and Campaign and meets the Campaign conditions. Compliance with advertising-disclosure rules remains your own responsibility (clause 8); Linkfluencer may nevertheless reject, or require the correction of, posts lacking required labels. If a claim is rejected because the post or the receipt does not meet the requirements, you will be told the reason and you may correct and resubmit once within seven (7) days. A Reward remains pending until verification is complete and the Brand's return or refund period has expired; refunded or cancelled purchases void the pending Reward. If you return the purchase after the Reward was confirmed or paid, your entitlement to that Reward lapses and Linkfluencer may deduct the corresponding amount from your wallet balance or set it off against future Rewards.

  • Transparency of rates and caps: the App shows you, before you shop and again before you submit a claim, the exact Reward rate or net amount applicable, including any deductions, the Campaign's maximum cashback amount and the monthly cashback ceiling per creator displayed in the App. The rate displayed when you make the Campaign purchase is guaranteed for that purchase provided you claim within fourteen (14) days (clause 5.1). Where the applicable rate is 100%, the maximum cashback amount displayed for the Campaign always applies.

  • Keeping the post live: you must keep the Content published and the Connected Account public for at least three (3) months after submitting the claim. Deleting the Content or making the account private before then may void the pending Reward or entitle Linkfluencer to recover the corresponding cashback already paid.

  • Payment: Linkfluencer is your sole debtor for Rewards, whatever its own arrangements with Brands. Confirmed Rewards are credited in euros to your ConnectPay account; on withdrawal you can convert to your local currency at the rates displayed. A minimum balance of €10 applies before withdrawal. ConnectPay may apply its own transaction and conversion fees, set out in its terms. Rewards are gross amounts: taxes and social charges on them are your responsibility (clause 3).

  • Linkfluencer may from time to time offer additional bonuses at its discretion. Any such bonus is a Reward under these Terms, including for the purposes of clause 7.

  • Once a Reward is confirmed, it is yours: confirmed Rewards are not forfeited on account closure or termination, except where they result from fraud or breach as described in clause 9, or from a breach of the three-month publication obligation above.

Content and intellectual property

Content and intellectual property

Content and intellectual property

Your Content generally

Content you create outside Campaigns, or for which no Reward is confirmed, remains yours. By posting it through or in connection with the App you grant Linkfluencer a non-exclusive, royalty-free licence to host, display and reproduce it as needed to operate and promote the App, including display in the App's public feed, for the duration of your account.

Assignment of rights in Rewarded Content

In consideration of the Reward paid to you, which you and we agree constitutes full and sufficient remuneration for both the Content services and the rights assigned, you assign to Linkfluencer, on an exclusive basis, the economic rights in each item of Rewarded

Content, under the following conditions, which the parties intend to satisfy Articles L.131-2 and L.131-3 of the French Intellectual Property Code:

  • Scope of rights assigned: the rights of reproduction, representation and communication to the public, adaptation, modification, translation, distribution and marketing of the Rewarded Content, in whole or in part.

  • Authorised uses: use in any advertising, marketing, promotional and commercial context, including: sublicensing to the Brand concerned and to other Brands; paid amplification and social advertising in any form (including TikTok Spark Ads and Meta partnership ads run from Brand or Linkfluencer accounts); publication on Linkfluencer's own websites, applications, social channels and app-store materials; and use in Linkfluencer's investor, press and sales materials.

  • Media: all current media and formats, digital or physical, including social networks, websites, applications, streaming, display, print and out-of-home.

  • Territory: worldwide.

  • Duration: twelve (12) months from the date the corresponding Reward is confirmed to you.

  • Reversion: on expiry of that 12-month period, the assigned rights revert to you automatically and without formality. Linkfluencer and the Brands then retain a non exclusive, royalty-free, worldwide licence, for the residual legal term of the rights, limited to continuing the display and distribution of materials lawfully published or produced during the assignment period. No new exploitation of the Rewarded Content will be initiated after reversion.

  • Your own use: during the assignment period, Linkfluencer grants you back a non-exclusive licence to keep the Rewarded Content published on the Connected Accounts where you posted it, and to show it in your personal portfolio. You agree not to license the Rewarded Content to third parties (including competing brands) during the assignment period, since the assignment is exclusive.

  • Moral rights: your moral rights are not assigned. To the extent permitted in the UK, you waive your rights to be identified and to object to derogatory treatment in respect of the authorised uses; in France, where moral rights cannot be waived, you accept that the authorised uses may involve reasonable editing, cropping, reformatting, subtitling and combination with brand elements, and that Rewarded Content may be used without name credit where the format makes credit impracticable.

In plain terms

If Linkfluencer pays you a Reward for a piece of content, Linkfluencer owns the commercial rights to that content for 12 months and can use it anywhere, including in ads, for the brand and for Linkfluencer. Your posts stay live on your own accounts. After 12 months the rights come back to you, and what was already published can simply stay published. Content you were never paid for remains entirely yours.

Your warranties about Content

  • The Content is your original creation, and you hold or have cleared all rights in it, including music. Campaign conditions require the use of royalty-free or commercially licensed audio: music licensed by a social platform for personal posts is NOT cleared for advertising reuse and must not be used in Campaign Content.

  • Any person appearing in the Content has given you the permissions needed for the uses described in clause 7.2 (image rights).

  • The Content complies with clause 8, with applicable law and with the rules of the platform where it is posted.

  • AI tools: you may use AI tools to assist your creation, but the Content must reflect your genuine purchase and experience and must not be entirely synthetic. Realistic AI generated or AI-manipulated imagery must be labelled as such, in line with the transparency requirements of Regulation (EU) 2024/1689 (AI Act) and the rules of the platform concerned.

  • You indemnify Linkfluencer and the Brands against third-party claims arising from a breach of these warranties.

Prohibited conduct, fraud and consequences

Prohibited conduct, fraud and consequences

Prohibited conduct, fraud and consequences

The following are serious breaches of these Terms:

  • submitting false, altered, duplicated or third-party proof of purchase, or claiming the same purchase more than once (including across accounts);

  • artificial engagement of any kind: purchased followers, bots, engagement pods, view farms, coordinated inauthentic behaviour, or any manipulation of the Social Score;

  • posting Content that is illegal, misleading, defamatory, hateful, sexually explicit, dangerous or that infringes third-party rights;

  • using the App for money laundering or any unlawful purpose, or circumventing a suspension with a new account.

In case of established fraud or serious breach, Linkfluencer may: void pending Rewards derived from the breach; recover (claw back) Rewards already paid that are the direct proceeds of fraud; suspend or terminate your account under clause 11; and report the matter to the authorities. Rewards unrelated to the breach remain payable.

Moderation of the in-app feed and appeals

Content displayed in the App's public feed is moderated. Linkfluencer may remove or restrict Content, or suspend an account, where the Content is illegal or breaches these Terms. In line with Regulation (EU) 2022/2065 (Digital Services Act), when we remove or restrict your Content or suspend your account, we will give you a clear statement of reasons, and you may contest the decision free of charge through our internal complaint system (in the App or at team@linkfluencer.io) within six months. This also applies to decisions declining an application or offboarding an account under clause 3. Your right to refer the matter to a certified out-of-court dispute settlement body or to a court is unaffected.

Data protection

Data protection

Data protection

Linkfluencer processes your personal data (including data retrieved from Connected Accounts, proof-of-purchase data and Social Score data) as described in its Privacy Policy, in accordance with the GDPR, the UK GDPR and French data protection law. Data is shared with ConnectPay for account opening, KYC and payouts, and with Brands to the extent needed to run Campaigns. The Social Score involves automated processing; your rights in that respect are described in clause 5.2 and in the Privacy Policy.

Suspension, termination and account closure

Suspension, termination and account closure

Suspension, termination and account closure

  • Right of withdrawal: if you are a consumer, you may withdraw from this contract without giving any reason within 14 days of accepting these Terms, by writing to team@linkfluencer.io (a model withdrawal form is available on request). Withdrawal does not affect Rewards already confirmed at that date.

  • By you: you may close your account at any time via the App or by writing to team@linkfluencer.io. Confirmed Rewards remain available to you through ConnectPay.

  • By us, with notice: we may terminate your account with 30 days' notice, including if you have been inactive for more than 12 months or if we withdraw the App from your country.

  • By us, immediately: we may suspend or terminate your account without prior notice in case of serious breach (clause 9), suspected fraud pending investigation, failure to complete KYC within a reasonable period, or where required by law. Where we suspend on suspicion, we will investigate diligently, tell you the outcome and lift the suspension if the suspicion is not confirmed.

  • Clauses that by nature survive termination (including clauses 7, 9, 12 and 13) survive it.

Liability

Liability

Liability

  • Linkfluencer's obligations under these Terms are obligations of means. We do not guarantee earnings, Campaign availability, score levels, or uninterrupted operation of the App.

  • Brands, not Linkfluencer, are responsible for their products and services. ConnectPay, not Linkfluencer, is responsible for the operation of your payment account.

  • To the extent permitted by law, Linkfluencer is not liable for indirect or consequential losses, and its total liability under these Terms is capped at the greater of €500 and the Rewards confirmed to you in the 12 months preceding the event giving rise to liability.

  • Nothing in these Terms excludes or limits liability for wilful misconduct, gross negligence, death or personal injury, or any liability that cannot be excluded by law, and nothing deprives you of mandatory consumer rights in your country of residence.

Changes to these Terms

Changes to these Terms

Changes to these Terms

We may amend these Terms as the platform evolves. Material changes will be notified in the App at least 15 days before they take effect (except changes required by law or urgent security measures, which may apply immediately). If you do not agree with a change, you may close your account before the change takes effect; continuing to use the App after that date constitutes acceptance. Changes to the Social Score system are governed by clause 5.1.

General

General

General

If a provision of these Terms is held invalid, the remainder stays in force and the invalid provision is replaced by a valid one reflecting its intent. Our failure to enforce a right is not a waiver. You may not transfer your account or rights under these Terms; Linkfluencer may transfer this agreement within its group or in connection with a corporate transaction, provided your rights are not reduced. These Terms, the Campaign conditions, the Privacy Policy and the Cookie Policy form the entire agreement between us regarding the App.

Governing law, mediation and disputes

Governing law, mediation and disputes

Governing law, mediation and disputes

These Terms are governed by French law. If you are a consumer, you also benefit from the mandatory protections of the law of the country where you live, and you may bring or face proceedings before the courts of that country as provided by applicable rules of jurisdiction; otherwise, the courts of Créteil, France, have jurisdiction. Before any court action, we will try to resolve disputes amicably: write to team@linkfluencer.io and we will respond within 30 days. If you are a consumer residing in France or the EU and the disagreement persists, you may refer the matter free of charge to a consumer mediator (médiateur de la consommation); the identity and contact details of the mediator appointed by Linkfluencer are listed in the App's legal notices. UK residents may have recourse to alternative dispute resolution schemes as indicated in the App.

How to Delete Your Account

You can delete your Linkfluencer account at any time, using either method below.

From within the app

Open the Linkfluencer app and sign in to your account.

Go to Profile → Personal Information.

Scroll to the bottom and tap Delete Account.

Tap Delete in the confirmation dialog.

Your account is closed and you are signed out immediately. This action cannot be undone.

By email

If you have uninstalled the app or cannot sign in, write to team@linkfluencer.io from the email address registered to your account, with the subject line "Account Deletion Request". Include the phone number registered to your account so we can verify your identity. We will verify and action your request within 30 days.

What is deleted

When your account is closed, the following is erased from our active systems: your profile (name, email address, phone number, profile photo, date of birth); connected social media accounts and any performance metrics retrieved from them; smart links you created, together with their click and analytics data; your Social Score and its history; referral codes, referral history, and pending reward balances; and saved preferences and in-app activity associated with your account.

What is retained

We delete your account data on request. Records we are legally required to keep — invoices and transaction records under French accounting obligations, and fraud or dispute records — are retained for the periods set out in section 8 of this policy, then permanently deleted. Payout and identity verification (KYC) records are held by our payment partner ConnectPay under their own policy.
